Picture it: a consignor's antique cabinet is damaged during preview, or a painting is dropped while being moved to the block, or a sprinkler discharges in storage and ruins a consignment. Who pays? For most auctioneers the unwelcome answer is: you might — and your standard property policy won't help. Understanding why comes down to a phrase every auctioneer should know: care, custody, and control.
What 'care, custody, and control' means
When a consignor entrusts property to you to sell, that property is in your care, custody, and control until it leaves with the buyer. You're a 'bailee' — someone holding another's property for a purpose. With that role comes legal responsibility: if the property is damaged through your negligence while in your care, you can be liable to the consignor for the loss. And the value at stake is someone else's, which makes it personal.
Why your standard policies won't pay
Here's the trap. Your commercial property policy covers property you own — and it specifically excludes property of others, so it won't pay for a damaged consignment. And your general liability policy contains a 'care, custody, and control' exclusion that removes coverage for damage to property in your control. So the two policies most businesses rely on both specifically exclude exactly the situation an auctioneer faces most: damage to consigned goods. Without additional coverage, that loss falls on you.
How bailee coverage responds
Bailee (property-of-others) coverage is the policy built to fill that gap. It covers direct physical loss or damage to property of others while it's in your care, custody, and control — from intake and storage through preview, the sale, and post-sale holding. When a consigned item is damaged, bailee coverage responds so you can make the consignor whole without paying out of pocket. It's the single most important coverage for an auction business, precisely because the consigned-goods exposure is both the largest and the one standard policies exclude.
Getting it right
Two things matter most: having bailee coverage at all, and setting the limit to your peak consignment value rather than an average week — a single estate or major sale can multiply the value in your care overnight. High-value individual lots may warrant scheduled or agreed-value terms so they aren't capped by a blanket sublimit.
